TRAVEL PACKAGE SALES CONTRACT
BHS TRAVELADVISOR carries out the activity of intermediation of individual tourist services and the activity of organization and sale of tourist packages. The services and tourist packages illustrated on the website bhs.travel will be offered for sale under the conditions described therein.
BHS TRAVELADVISOR SRL, represented by its legal representative Ludovico Orlandi, with registered office in via De Dominicis 41 – 01028 Orte (VT), operates as a travel agency and tour operator with regular administrative authorization no. 641946 issued by the Lazio Region on 18/09/2017.
Civil Liability Insurance: Nobis Insurance Company S.p.A. policy no. 1505001994C
Traveler Guarantee: “FILODIRETTO PROTECTION” policy no. 6006003124/E, issued by Nobis Insurance Company S.p.A.
Subject and content of the tourist package sales contract
The travel contract includes, in addition to the following general conditions, the description of the tourist package contained in the catalog or in the separate travel program, as well as the booking confirmation of the services requested by the traveler. This is sent by the tour operator to the travel agency, acting as the traveler’s agent, and the traveler is entitled to receive it from the same agency. By signing the purchase proposal for the tourist package, the traveler must keep in mind that he/she acknowledges as read and accepted, for himself/herself and for the persons for whom the all-inclusive service is requested, both the travel contract as governed herein, the warnings contained therein, and these general conditions.
- Legal sources
The sale of tourist packages, relating to services to be provided both within national and international territory, is governed—until its repeal pursuant to Article 3 of Legislative Decree no. 79 of 23 May 2011 (the “Tourism Code”)—by Law 27/12/1977 no. 1084 ratifying and implementing the International Convention on Travel Contracts (CCV), signed in Brussels on 23.4.1970, insofar as applicable, as well as by the Tourism Code (Articles 32–51) and its subsequent amendments, and by the provisions of the Civil Code on transport and mandate, insofar as applicable. Further legislative provisions—whose implementation may occur during the validity of this catalogue and which may modify or repeal the contractual conditions below—will be made available online through publication on the Tour Operator’s website.
- Administrative regime
The organizer and intermediary of the tourist package to whom the traveler refers must be authorized to carry out their respective activities under current legislation, including regional laws, given their specific competence.
The organizer and intermediary disclose to third parties, before the conclusion of the contract, the details of the insurance policy covering professional civil liability risks, as well as the details of other guarantee policies towards travelers covering events that may affect the execution of the holiday, such as trip cancellation, medical expenses, early return, loss or damage of baggage, as well as insolvency or bankruptcy of the organizer and intermediary, each within their respective competence, for the purpose of refunding amounts paid or ensuring the traveler’s return to the place of departure.
Pursuant to Article 18, paragraph VI, of the Tourism Code, the use in the company name or business name of the words “travel agency”, “tourism agency”, “tour operator”, “travel intermediary” or other similar expressions, including in foreign languages, is permitted exclusively to authorized companies referred to in the first paragraph.
- Definitions
For the purposes of this contract:
- a) organizer: the entity that undertakes in its own name and for a fixed total price to procure tourist packages for third parties, or offering the traveler, also through a remote communication system, the possibility to independently create and purchase such combination;
- b) intermediary: the entity that, even non-professionally and without profit motive, sells or undertakes to procure tourist packages for a fixed price;
- c) traveler: the purchaser, assignee of a tourist package or any person, even to be appointed, provided they meet all conditions required to use the service, on behalf of whom the main contractor undertakes to purchase a tourist package without remuneration.
- Definition of tourist package
The definition of tourist package is as follows:
A combination, however and by whomever arranged, of at least two of the following elements, sold or offered for sale at an inclusive price: a) transport; b) accommodation; c) tourist services not ancillary to transport or accommodation referred to in Article 36, which constitute a significant part of the “tourist package” for the satisfaction of the traveler’s leisure needs (Article 34 Tourism Code). The traveler is entitled to receive a copy of the tourist package sales contract (drawn up pursuant to Article 35 Tourism Code).
- Information for the traveler
Before the start of the trip, the organizer and intermediary communicate the following information to the traveler:
- Itinerary: the travel program contains essential information regarding the destination and any stops along the route with related periods of stay. The program may be subject to changes decided by the organizer in agreement with the group during the trip and/or due to unforeseen or unavoidable circumstances (such as weather conditions, accidental mechanical breakdowns of transport means, and similar events).
- Means of transport: the travel program indicates the main characteristics and categories of transport used to reach and return from the destination; the cost of transport services may be divided between participation fee and BHS fund.
- Air flights: departure and arrival dates are indicated. If exact times are not yet defined, BHS TRAVELADVISOR informs the traveler of approximate departure and return times.
In any case, the final flight schedule is communicated to the traveler on a durable medium before departure via the final information sheet sent to the contact details provided by the traveler.
When completing the booking form, the traveler must indicate a second choice of departure city between Rome and Milan, from which the flight to the final destination will depart and to which return will be made.
If the traveler chooses a departure city other than Rome or Milan, they must contact BHS TRAVELADVISOR to receive a customized quotation.
- Car rental: where rental does not include a driver, travelers must agree to alternate driving of the rented vehicle(s), provide driving license details to the coordinator before departure, and where required provide a credit card as guarantee.
- Accommodation: main accommodation features are described in the travel program and, where possible, the names of the structures are indicated in the contract.
- Meals: when included in the tourist package, breakfast, half board, or full board treatment is indicated in the travel program and in the “price includes” section.
- Visits and excursions: when included, same applies; extra excursions may be offered and are optional. Payment must be made before departure.
- Reservations
The purchase proposal must be completed on a specific contractual form, electronic where applicable, filled in entirely and signed by the customer, who will receive a copy. Acceptance is completed only when the organizer sends the confirmation to the traveler, also via electronic system. Special requests must be agreed in advance.
NOTE: Name and surname must exactly match the identity document used for travel. Any mismatch may result in airline penalties fully charged to the traveler.
- Payments
At the time of signing:
- a) registration fee of €100 as deposit for bookings via bhs.travel;
- b) 50% advance payment of the package price (including BHS fund);
- c) balance to be paid within the deadline indicated by the Tour Operator.
If payment is made within 5 days before departure, proof of payment must be shown; otherwise boarding may be denied.
The BHS fund is fixed and non-modifiable.
- Price
The price may be adjusted only due to changes in transport costs, taxes, or exchange rates, but not within 20 days before departure and not exceeding 10%.
The price includes base participation fee, insurance, BHS fund, possible departure surcharges, visas, and additional services.
- Modification or cancellation before departure
The organizer may modify non-essential conditions. Significant changes may entitle the traveler to withdraw without penalties or accept alternatives.
Refunds are made within 14 days, except in cases of force majeure, insufficient participants, or traveler fault.
- Traveler withdrawal
The traveler may withdraw without penalty in specific cases; otherwise penalties apply depending on timing before departure.
Refund percentages vary depending on days before departure.

- Post-departure modifications
If services cannot be provided, alternatives or refunds are offered, except in cases of force majeure.
- Substitutions
The traveler may transfer the contract under certain conditions, sharing responsibility for costs.
- Traveler obligations
Travelers must comply with travel documents, health requirements, and official travel information sources.
- Hotel classification
Hotel classifications depend on official local authorities or organizer descriptions where no official classification exists.
- Liability regime
The organizer is responsible unless force majeure or traveler fault applies.
- Compensation limits
Compensation is limited by applicable conventions and law.
- Assistance obligation
Assistance is provided according to professional diligence standards.
- Complaints
Complaints must be made during the trip and within 10 days after return via email or certified mail to bhstraveladvisorsrl@legalmail.it
- Insurance
Travel insurance is optional unless included.
- Alternative dispute resolution
Alternative dispute mechanisms may be offered by the organizer.
- Guarantee fund
Travelers are protected against insolvency through insurance guarantees.
- Operational changes
Programs may change before departure and must be accepted by travelers.
- Release
The traveler authorizes the use of images taken during the trip for promotional purposes.
Addendum – Terms for single travel services
- a) Legal provisions
Single services are governed by CCV and relevant civil code provisions.
- b) Contract conditions
Certain clauses apply but do not constitute a package travel contract.
